FormSpherePro is a product of KCRD Enterprise
1. Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and KCRD Enterprise ("Company," "we," "us," or "our") concerning your access to and use of the FormSpherePro website and service (collectively, the "Service"). By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, you are prohibited from using the Service.
2. Description of Service
FormSpherePro is a web-based form builder platform that allows users to create, customize, distribute, and manage online forms. The Service includes both free and paid subscription tiers with varying features and limitations.
3. User Accounts
Account Creation: To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity.
4. Subscription Plans and Billing
Free Plan: Limited to 1 form and 30 submissions per month with basic features.
Pro Plan: $39.99 per month, billed monthly. Includes unlimited forms, unlimited submissions, custom branding, form templates, AI logo generator, and priority support.
Payment Processing: All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize KCRD Enterprise to charge your payment method.
Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.
Changes to Pricing: We reserve the right to modify our pricing. We will provide advance notice of any price changes.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Transmit malicious code, viruses, or harmful software
- Engage in spam, phishing, or fraudulent activities
- Collect personal information without consent
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to our systems
- Use the Service for any illegal or unauthorized purpose
6. User Content
Ownership: You retain all ownership rights to the content you create using the Service, including forms and collected data.
License to Us: By using the Service, you grant us a limited license to host, store, and display your content solely for the purpose of providing the Service.
Responsibility: You are solely responsible for the content you create and collect. We are not responsible for the accuracy, legality, or appropriateness of user-generated content.
Content Removal: We reserve the right to remove any content that violates these Terms or applicable laws.
7. Intellectual Property
The Service, including all software, design, text, graphics, logos, and other content (excluding user content), is the property of KCRD Enterprise and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.
8. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

10. Disclaimer of Warranties

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KCRD ENTERPRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless KCRD Enterprise and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
